GENERAL CONDITIONS OF USE OF THE SITE

Preamble:

The purpose of the present general terms and conditions of use of the Site (hereinafter the "Terms and Conditions"), published by MANITOU BF (hereinafter "MANITOU") is to set out the terms and conditions of use of the Site.

Any person having access to the Site and the services offered, in whatever capacity, the place where they are located, the connection methods, the purpose and aim of their access, is a user (hereinafter "the User").

The User is presumed to know and accept, without reservation, the TOS in their latest version by the sole fact of his connection and consultation to the Site. MANITOU may update the GCU without prior notice or information. The User is therefore advised to refer regularly to the latest version of the GCU.

 

 

PURPOSE OF THE SITE

The Site is intended to present:

  • Products and services provided by MANITOU BF and its subsidiaries,
  • The dealer network,
  • Information of all kinds.

 

 

PRIVATE DATA

Consultation of the Site is possible without the User having to reveal their identity or any other personal information concerning them.

However, the User has the possibility of using the Site's services in order to contact MANITOU, one of its subsidiaries or one of its dealers directly. In this case, and in order to respond to the User's request (purpose of processing), the data relating to his identity and location (filled in with the appropriate fields) and possibly his geolocation will be processed by MANITOU. This data will be kept for the duration of the execution of the request, and for six months at the latest from the date of the request.

The recipients of this personal data are the MANITOU dealer or subsidiary identified and able to respond directly to the User.

The legal basis for this processing is the consent of the User, previously informed, before sending the request.

In accordance with the French Data Protection Act No. 78-17 of 6 January 1978 as amended and in accordance with Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data, the User may exercise his rights of access, opposition, rectification and portability to data concerning him by sending his request to privacy@manitou-group.com. The User may consult the cnil.fr website for further information or to make a claim on his rights.

 

 

CONTENT OF THE SITE - Showcase site

On the Site, MANITOU provides Users with information relating to its products and services for information purposes only and in a non-exhaustive manner.

Thus, the photos and explanatory texts are not intended to specify the characteristics of each product and service. It is for this reason that MANITOU makes available the information necessary to contact directly its dealer network and/or its subsidiaries, which are in a position to advise and inform. The information disseminated on the Site will be regularly updated.

The documents/information sheets/information have no contractual value.

 

 

ACCESS TO THE SITE - USE - SECURITY

The User can connect and visit the Site without a login. Only an internet connection is required.

The User acknowledges that he/she is suitably equipped, in particular in terms of computing, telecommunications and security, to access and use this Site. All costs and expenses relating to equipment, communications, telecommunications and others, necessary for the connection and use of the Site, as well as any necessary authorization relating thereto, shall be borne by the User.

While MANITOU makes every effort to ensure that the Site is accessible 24 hours a day and 7 days a week, it is possible that in the context of testing, maintenance, updating, interventions in the event of breakdowns, the Site may be inaccessible and/or incomplete. MANITOU therefore reserves the right to close down or make all or part of the Site inaccessible.

The User undertakes not to disrupt the operation of the Site and not to use the communication services in an untimely manner. The User undertakes to use the Site or its content in accordance with national and international regulations and in such a way as not to damage MANITOU's reputation.

MANITOU implements the appropriate technical and organizational measures, in accordance with the rules of art, to protect data against accidental or illicit destruction, accidental loss, alteration, distribution or unauthorized access.

 

 

RESPONSIBILITY

MANITOU does not provide any guarantee as to the accuracy, precision or updating of the information on the Site.

MANITOU or any subsidiary that may be substituted for it cannot be held responsible for the interpretation, exhaustiveness, completeness and updating of the data and information contained on the Site.

Under no circumstances may MANITOU's liability of any subsidiary that may be substituted for it be engaged for any damage, of any nature whatsoever, resulting directly or indirectly from the use of the Site, in particular, but not exclusively, from a virus that may damage or render unusable the User's computer equipment.

The User therefore waives any recourse against MANITOU for all damages of any nature whatsoever such as, and without this list being exhaustive, loss of data, programs or files, financial losses, damage to computer equipment (including in particular connections, software, hardware), the appearance of viruses due to access, use or unavailability of the Site, recourse relating to the rights and licenses required for use and access to the Site.

 

 

INTELLECTUAL PROPERTY

The Site and its content, including the databases that make up all or part of the Site, are the property of MANITOU or are subject to authorization for use, as regards both its general design and the software, graphics, databases, design, photographs and images, texts, drawings, sounds and all other works that make up the content of the Site.

The User undertakes to strictly respect these intellectual property rights.

Any total or partial representation or reproduction of the Site, whether in return for payment or free of charge, without the prior written authorization of MANITOU, the author and publisher or their successors in title or assigns is prohibited, except for the strict requirements of online consultation.

The brands and logos appearing on the Site are registered trademarks. In particular, the Manitou, Braud & Faucheux, Buggyscopic, Manitransit, Manihoe, Manilec Produits Blanc, Maniaccess, Maniloader, Manitou Finance, Gehl, Mustang by Manitou brands are brands belonging to MANITOU or its subsidiaries.

Any reproduction, use, imitation, affixing, deletion or modification of these elements without the prior written authorization of Manitou BF or one of its subsidiaries is prohibited and constitutes an act of counterfeiting punishable by law.

 

 

HYPERTEXT LINKS

The Site is likely to contain hypertext links with other sites ("third party sites"). Manitou BF has no power of control over these Third Party Sites, which are administered independently by their operators. Consequently, Manitou BF cannot under any circumstances be held responsible for the harmful consequences for the User of access to a third party site following the activation of a hyperlink on the Site.
